1. Who we are and scope

This website is owned and operated by Kariasa Cosmetics di Federico Zonca (“Kariasa”, “we”, “us”), based at Via Pietrino Solinas 21/b, 07043 Bonnanaro (SS), Italy. VAT No. 03060660903, Tax Code ZNCFRC78A14G113C, registered with the Companies Register of the Sassari Chamber of Commerce (CCIAA), REA No. SS-226688. Email: kariasacosmetics@gmail.com. These Terms govern your use of the website and the distance sale of our cosmetic products through kariasa.it. They do not apply to purchases made in person at our premises or from our retailers. They are addressed to consumers (individuals who buy for purposes outside their trade, business or profession) and, where applicable, to other customers as well. The protections that the Italian Consumer Code (Legislative Decree 206/2005) gives to consumers cannot be limited by any provision of these Terms.

If we agree special terms with you in writing, they take precedence over these Terms to the extent expressly agreed.

2. Acceptance of these Terms

By browsing the site, registering or placing an order, you confirm that you have read these Terms. Before you complete a purchase, we will ask you to confirm explicitly that you have read and accepted them by ticking the relevant box. We recommend that you save or print a copy of these Terms, which we will also send you by email with your order confirmation.

3. Registration and accounts

You can buy from us without creating an account, as a guest; some features (for example, leaving a review) may require you to log in. You agree to provide accurate, complete and up-to-date information and to keep your login details safe: you are responsible for all activity under your account. If you suspect unauthorised use, let us know straight away. You must be at least 18 years old to buy.

4. Products and product information

We do our best to describe our products accurately, but the colours and packaging shown on screen may differ slightly from the real thing. For each product, the product page or the packaging gives the list of ingredients (INCI), directions for use, warnings and period of use after opening (PAO), in accordance with Regulation (EC) No 1223/2009.

Cosmetics can cause reactions in people with sensitive skin or allergies. Always read the INCI list before use, patch-test on a small area of skin if your skin is sensitive, and stop using the product if irritation occurs. The information on the site is for general information only and is not a substitute for advice from a doctor or dermatologist.

5. Prices and payment

All prices are in euros and include VAT, where applicable. Shipping costs and any additional charges are clearly shown before you confirm your order. We may change our prices at any time; the price that applies is the one shown when you place your order.

You can pay by any of the methods offered at checkout: credit or debit card, MyBank, Google Pay, PayPal or bank transfer. Card payments are handled by third-party payment providers, and we do not store your full card details. We process your order once we have confirmed that payment has been received.

6. How the contract is formed

The purchase process consists of: selecting your products, entering your delivery details, choosing your shipping and payment methods, checking the order summary, and confirming with the final button, which clearly states that placing the order means you are obliged to pay. You can correct any input errors before you confirm.

After you place your order, you will receive a confirmation email containing the order summary, these Terms and information about withdrawal. The contract is formed when we send you that confirmation. We may cancel an order, with a full refund, if a product is unavailable, if there is an obvious pricing error or if we suspect fraud.

7. Shipping and delivery

We ship worldwide, subject to any local restrictions on importing cosmetic products. Shipping costs depend on the destination and the contents of your order, and are shown in the cart and at checkout before you confirm; shipping is free on orders of €70 or more. We do not use a fixed carrier: for each order we choose the most cost-effective service available, including through shipping platforms. We prepare your parcel and hand it to the carrier within 7 working days of payment confirmation. Delivery times depend on the carrier and the destination, so they are estimates only. For shipments outside the European Union, customs duties, taxes and import charges may apply and are payable by the recipient.

Unless we state a different date, we will deliver within 30 days of the contract being formed. When your parcel arrives, check that it is intact; if it is visibly damaged, accept it with a note of the damage and write to us within 7 days, attaching photos. The risk of loss or damage passes to you when you receive the goods.

8. Right of withdrawal

8.1 How it works

If you are a consumer, you have the right to withdraw from the contract within 14 days, without giving any reason. The 14 days run from the day on which you, or a third party you have named (other than the carrier), take physical possession of the goods. If you order several products that are delivered separately, the period runs from delivery of the last one.

To withdraw, you can:

  • use the withdrawal function on the site, on the “Withdrawal from the contract” page (“Recesso dal contratto”, kariasa.it/my-account/withdraw-order), which you can reach through the “Withdrawal” link (“Recesso”) at the bottom of every page and which you can use without creating an account, throughout the withdrawal period; or
  • send us an unequivocal statement of your decision by email to kariasacosmetics@gmail.com or to our PEC address, federico.zonca@pec.agritel.it.

We will confirm receipt of your withdrawal without delay on a durable medium (for example, by email). To meet the deadline, it is enough to send your withdrawal notice before the 14-day period expires.

8.2 Returning the goods

You must send the goods back, or hand them over to us or to a person authorised by us, without undue delay and in any event within 14 days of telling us that you are withdrawing, to: Kariasa Cosmetics, Via Pietrino Solinas 21/b, 07043 Bonnanaro (SS), Italy. You bear the direct cost of returning the goods.

We recommend returning the products in their original packaging and using a tracked service, as the risk of loss or damage on the return journey is yours.

8.3 Refund

We will refund all payments we have received from you, including standard delivery costs, without undue delay and in any event within 14 days of receiving your notice of withdrawal. We do not refund any extra costs resulting from your choice of a more expensive delivery method than the standard one we offer. We will refund you using the same payment method you used for the purchase, at no cost to you. We may withhold the refund until we have received the goods back or you have provided proof that you have sent them back, whichever is earlier.

8.4 Exceptions and loss of value

For hygiene and health protection reasons, you cannot withdraw from the purchase of sealed cosmetic products that have been opened, or whose safety seal has been broken, after delivery (art. 59(e) of the Italian Consumer Code). The right of withdrawal also does not apply to goods made to your specifications or clearly personalised. If you return a product that is unsealed or has been used beyond what is needed to establish its nature and characteristics, you are liable for any loss in its value.

So please do not open sealed products if you think you may want to return them.

As a consumer, you are entitled to the legal guarantee of conformity under articles 128 et seq. of the Italian Consumer Code: the seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery. If a product is defective, you may obtain, in accordance with the law, repair or replacement of the product or, where the conditions are met, a price reduction or termination of the contract.

To report a defective or damaged product, or one that differs from what you ordered, email kariasacosmetics@gmail.com, stating your order number and attaching photos of the product and its packaging. You must report the defect within 2 months of discovering it. The guarantee does not cover damage caused by misuse or improper storage, or the normal expiry of products.

10. Limitation of liability

Nothing in these Terms excludes or limits our liability where the law does not allow it, in particular for wilful misconduct or gross negligence, personal injury, defective products and a consumer’s mandatory rights.

To the extent permitted by law, we are not liable for indirect loss, loss of profit or loss of data arising from your use of the site, or for interruptions or malfunctions caused by matters beyond our control (for example, problems with the network or third-party systems). We do not guarantee that the site will always be available or error-free, and we may modify, suspend or discontinue it, in whole or in part, without notice, without prejudice to orders already confirmed.

11. Intellectual property

Trademarks, logos, text, photographs, graphics, descriptive wording and all other content on the site belong to Kariasa or its licensors and are protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, modify, systematically extract data from or commercially exploit the content without our written permission, except for uses permitted by law (for example, the right to quote). No licence is granted to you, other than the right to use the site for personal purposes, to browse and buy our products.

12. Acceptable use

You agree to use the site in accordance with the law, these Terms and the principle of good faith. In particular, you must not: spread viruses or other harmful software; compromise the security, operation or availability of the site; use automated systems (bots, scrapers) to collect data; use data obtained from the site for unauthorised direct marketing; or bypass security or access controls. If you breach these rules, we may suspend or close your account and take action to protect our rights.

13. User content and submissions

If you send us ideas, suggestions, reviews, photos or other content, you confirm that you have the right to share them and you grant us a free, non-exclusive right to use, reproduce and publish them for purposes related to promoting and improving our products and services. Please do not send us confidential or protected ideas or materials unless we have first agreed a confidentiality agreement with you in writing. You can ask us at any time to remove content you have posted, within the limits of the law.

14. Third-party sites

The site may contain links to third-party websites that we do not control. We are not responsible for their content, their privacy practices or the products and services they offer; please read their own terms.

15. Electronic communications

We communicate with you by email or through the site. To the extent permitted by law, communications sent electronically satisfy any requirement that they be in writing. We send you service messages relating to your orders; we send promotional messages (newsletters) only with your consent, which you can withdraw at any time.

16. Privacy and cookies

We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003. Information on purposes, legal bases, retention and your rights is set out in our Privacy Policy and Cookie Policy.

17. Accessibility

We are committed to making the site accessible to people with disabilities. If you have difficulty accessing any content or feature, email us at kariasacosmetics@gmail.com describing the problem, and we will do our best to resolve it within a reasonable time.

18. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (for example, natural events, strikes, transport disruption, network failures or acts of the authorities), for as long as those events last. Your payment obligations and your consumer rights remain unaffected, including your right to a refund if we cannot deliver your order.

19. Complaints and dispute resolution

For any complaint, you can email us at kariasacosmetics@gmail.com or contact us on +39 329 762 4605 (also via WhatsApp), Monday to Friday, 8:30 a.m. to 7:00 p.m. (Italian time). We will reply as soon as possible, usually within a few working days. If you are not satisfied with our reply, you remain free to contact the competent authorities and the alternative dispute resolution (ADR) bodies for consumers provided for by law. Kariasa does not currently participate in any ADR body.

20. Governing law and jurisdiction

The contract is governed by Italian law. If you are a consumer, the mandatory provisions protecting you under the law of the country where you live continue to apply and, for disputes, the court of your place of residence or domicile has exclusive jurisdiction, if it is located in Italy (art. 66-bis of the Italian Consumer Code). For customers who are not consumers, the courts of Sassari have jurisdiction.

21. Changes to these Terms

We may update these Terms from time to time, showing the date of the latest revision at the top. Changes apply to orders placed after they are published; orders already confirmed remain subject to the Terms in force when you made your purchase. If changes materially affect your account or any ongoing services, we will notify you in advance by email. You can ask us for a copy of earlier versions.

22. General provisions

If any provision of these Terms is declared void or unenforceable, the remaining provisions stay valid. Our failure to exercise a right is not a waiver of it. You may not assign your rights and obligations under these Terms to anyone else without our written consent, without prejudice to your rights as a consumer. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kariasa Cosmetics di Federico Zonca regarding your use of the site. The original Terms are written in Italian, which is the language of our communications. This English version is provided for convenience and, if there is any discrepancy, the Italian version prevails.
